Banned 'aphrodisiac' in UAE groceries

An herbal 'aphrodisiac' banned by the Indian government is available in some supermarkets and groceries in the UAE.

Musli Power Xtra, produced by South India-based Kunnath Pharmaceuticals,claims to offer the complete solution for sexual problems in both men and women. The company currently sells the product online as Indian ginseng.
The medicine is quite popular among Non-Resident Indians, said a market source. It is available in some grocery shops and some pharmacies that sell such medicines. It is illegally smuggled into the country and sold at a high premium as Indian Ginseng. As prices in India have crashed, traders are cashing in on the Gulf markets," said another source.

While approving Musli Power Xtra formulation for commercial production, the main ingredient indicated was the seed of ‘Nilappana’ (Curculigo orchioides). However, Kunnath Pharma made the formulation with the extracts of Safed Musli, violating the provisions of the Drugs and Cosmetics Act, which clearly states such raw ingredients cannot be used for making any kind of medicine formulations, according to an official.

Advertisements such as “Musli Power Xtra makes first night the best night,” have helped the company make a fortune by selling the brand in India and abroad within six years of its launch.

The Kerala Drug Regulatory Authorities have filed cases against the company under Spurious Drugs Act, and another under Drugs and Magic Remedies (objectionable advertisement) Act, 1955.

The High Court of Kerala has extended till May 23 the interim order it passed on April 8 restraining the Kerala Government from taking any ‘coercive action’ against Kunnath Pharmaceuticals, the manufacturer of the ayurvedic drug, Musli Power Xtra, pursuant to the ban order issued by the government on April 2. Advocate A K Jayasankaran Nambiar who appeared in the court for Kunnath Pharmaceuticals said since the case has been adjourned for May 23, the company can continue the production and sale of the product till that date. He said the court will hear the government’s side when the case will come up, and pass the judgement accordingly. In an interim order passed on April 8, the High Court stayed the operation of the order of the Kerala Government dated April 2 against the manufacturer of the ayurvedic drug “Musli Power Xtra’, till April 11. On Tuesday, when the case came up for hearing for the second day, the court postponed it till the vacation is over. The Kerala Government had banned the drug, under section 33 EEC of the Drugs & Cosmetics Act, for violation of the provision of Rule 106 of the Drugs and Cosmetics Rules, 1945. According to government sources, violating the Drugs and Magic Remedies (Objectionable Advertisement) Act, 1954, the Kunnath Pharma was giving extensive publicity in print and visual media about its aphrodisiac product claiming cure for infertility. According to Rule 106, no manufacturer or distributor or seller can give advertisement on any specific drug that many cure the diseases specified in Schedule J. This Schedule includes, among other diseases, sexual impotency. Kunnath Pharma has given wide publicity for their aphrodisiac product Musli Power Xtra. The case has come into the bench of Justice P R Ramachandra Menon, who issued the interim order.
